b. By creating, uploading, or sharing an AI Character on OneAIWorld, you represent and warrant that:
- You have created the AI Character yourself or have all necessary rights, licenses, and permissions to use, share, and authorize OneAIWorld to use all elements of the AI Character.
- The AI Character does not infringe upon the intellectual property rights, publicity rights, privacy rights, or other rights of any third party.
- The AI Character complies with all applicable laws and regulations and does not violate any provision of these Terms.
c. You acknowledge that you are solely responsible for any AI Character you create, and OneAIWorld disclaims all liability arising from or related to such AI Characters.
d. You retain ownership of the original elements you contribute to any AI Character you create. However, by creating and sharing an AI Character on OneAIWorld, you grant OneAIWorld a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display that AI Character for the purposes of providing and promoting the Services.
e. AI Characters on OneAIWorld may incorporate or be inspired by existing fictional characters, personalities, or creative works. You acknowledge that:
- Such AI Characters constitute transformative use under fair use doctrine and copyright law.
- AI Characters are not intended to replace original works but rather to create new, transformative experiences through user interaction.
- AI Characters by their nature involve substantial creative input, modification, and transformation from their inspiration sources.
f. OneAIWorld does not claim ownership of third-party intellectual property and makes no representations regarding the ownership or rights to any intellectual property that may be referenced by AI Characters.
g. You may not create or use AI Characters that:
- Impersonate a specific living individual without their consent
- Primarily aim to reproduce, replicate, or distribute copyrighted content without transformation
- Are designed to generate content that violates our Content and Conduct policies
- Misrepresent or falsely imply endorsement by any individual, company, or organization
h. OneAIWorld respects the intellectual property rights of others and will respond to legitimate takedown requests in accordance with the Digital Millennium Copyright Act ("DMCA"). If you believe an AI Character on OneAIWorld infringes your copyright, please submit a DMCA takedown notice to oneaiworld00@gmail.com with the required information under 17 U.S.C. ยง 512(c)(3).
i. OneAIWorld reserves the right to remove any AI Character at its sole discretion, with or without notice.
j. You agree to indemnify, defend, and hold harmless OneAIWorld and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your creation, use, or sharing of any AI Character, your violation of these Terms or any applicable law, or your infringement of any third-party right, including intellectual property rights.
k. OneAIWorld provides AI Characters and related features "as is" and "as available" without any warranties of any kind. You acknowledge that AI technology is inherently experimental and that AI Characters may produce unexpected, inaccurate, offensive, or otherwise undesirable content despite OneAIWorld's safety measures. To the maximum extent permitted by law, OneAIWorld shall not be liable for any content generated by or through AI Characters, including any content that may be offensive, inaccurate, incomplete, or otherwise objectionable.
Disclaimer of Warranties
OneAIWorld is provided on an "as-is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee the accuracy, completeness, or reliability of the Services or the content provided therein. Your use of OneAIWorld is at your own risk.
